Summary Of Henry's Case
Henry was convicted in April 2019 for sexually assaulting his common-law wife, Evelyn. Henry claims that Evelyn exaggerated and fabricated a story that he sexually assaulted her.
According to Henry, Evelyn became jealous because he spent more time with their mentally-ill son than with her. Henry claims Evelyn threatened to have Henry sent back to prison. She soon begin accusing him of infidelity and her behavior worsen.
Their relationship became unhealthy and hostile. Henry wanted out the relationship. A week after Henry moved out, Evelyn accused him of sexual assault.
Post Conviction Remedies
Henry complains that his court appointed lawyer’s ineffectiveness contributed to his conviction. Henry believes that his attorney should have done much more to assure that there is a fair trial.
Henry plans to file a post conviction habeas allegation to complain that his conviction stems from his lawyer not conducting an adequate investigation, failing to seek out and interview witnesses and refusing to investigate Evelyn’s past.
